The Appellant has filed this appeal challenging the impugned order dated 16.04.2021 of D.R.T.-II, Mumbai. The date of filing is 07.07.2021 and there is a delay of 51 days in filing the present Appeal. The period during which the delay has been caused squarely comes within the pandemic times and by virtue of the decision of the Hon’ble Supreme Court in SuoMotu Writ Petition (C) No. 3/2020. The Ld. Counsel for the Appellant seeks the delay to be condoned.

The Respondents have vehemently opposed the application but considering the pleadings in the application and accompanying

affidavit and also the decision made by the Hon’ble Apex Court, I am inclined to condone the delay.

Hence, the delay is condoned. The application is allowed. The Appeal at Diary No. 316/2021 shall be taken on file if there are no other defects to be cured.
