Present: Shri Ajay Kumar Singh, counsel for the appellant, Shri Rakesh Mishra, counsel for the respondent-Bank,
Learned counsel for the appellant submits that the respondents no. 1 & 6 have been served, but he could not file affidavit of service along with tracking report, therefore, he seeks time to file the same within three days. He further submits that the notices sent to the respondents no. 2 to 5 have returned back with endorsement “the addresses are not residing” at the given address.
Let fresh steps be taken by the counsel for the appellant within 15 days for service of notice upon the respondents no. 2 to 5 through publication in the newspapers having wide circulation in the area. Affidavit of service along with proof of publication be filed by the next date.
Learned counsel for the respondent-Bank seeks time to file reply, which may be filed by the next date.
List this case on 03.11.2022 for service. Till then the interim order, if any, shall remain operative.
