Shri Satyajit Mukherji, Ld. Counsel for the appellant is present and files Waiver Application. In regard to delay, Application for Condonation of Delay filed with the Appeal. Defects reconciled. Proper court fee paid. Shri Shailendra Kumar, holding brief of Shri Shashi Dhar Sahai, Ld. Counsel for the respondent-Bank is present.
No pre deposit has been made. Waiver Application has been filed. As per the Judgment in O.A. dated 06.08.2019 the dues of Bank was Rs. 30,52,980/- + interest (page 30 of the instant appeal). It has been mentioned that during the pendency of the O.A. the borrower had deposited more than Rs. 15 lakh upto 28.12.2018. Ld. Counsel states that he will argue before the Hon’ble Court.
The instant Application has been filed under section 20 of the RDB Act against final order dated 21.04.2022 of DRT, Patna in R.A. No. 13/2019 and O.A. No. 792/2018 dated 06.08.2019. Delay Condonation Application (I.A. No. 130/2022), Waiver Application (I.A. No. 638/2022) have been filed.
