Learned counsel for the appellant submits that the question, which shall be pressed, is only with regard to irregularity or illegality committed by the Bank in possession notice and quantum of compensation awarded by the Tribunal below.
Learned counsel for the respondent No. 2 contends that the appellant has proceeded against a dead person and the impugned order has been passed on that ground. Thus, there is no illegality or irregularity in the impugned order. The learned counsel further contends that he shall file reply only on this limited aspect.
Learned counsel for the respondent No. 5 may also file reply on that limited issue.
Issue notice to the respondents No. 1, 3 and 4 by two modes i.e. Registered Post with A.D. and Speed Post. Steps to be taken by the appellant within a week. Affidavit of service along with tracking report be filed by the next date.
List this case on 22.03.2023 for service.
