The office report dated 29.04.2022 shows that the affidavit of service has been filed without tracking report. The said report further reveals that no one has appeared on behalf of the respondent nos. 2 to 5 and notice sent to the respondent no. 4 has returned back with endorsement “refused”. Therefore, service of notice upon the respondent no. 4 is deemed to be sufficient. The office report further states that neither A.D. Cards nor envelops with regard to the service upon the respondents no. 2, 3 & 5 has returned back. Reply and rejoinder on the delay condonation application has been filed. Waiver application is pending consideration.
