Shri Vijay Gopal, Ld. Counsel for the Appellant is present and submits date and events and mentioned pin codes. Ld. Counsel also submits deficient court fee of Rs. 6800/- by way of SBI DD No. 823451 dated 30.11.2022. Defects reconciled. Proper court fee paid.
No pre deposit has been made. Waiver Application has been filed. As per the Notice of Sale dated 07.10.2021 (para 7 of page 79 of instant Appeal) dues was Rs. 17,70,923=01 P as on 31.03.2019 with interest. It has been mentioned in the Waiver Application that the business of the Appellant is not running well. However, in para 5.12 of the Appeal it has been mentioned that the Bank sold the property in auction for Rs. 21.10 Lakh. A copy of the Sale Certificate is also available at page 50 of the Appeal. Ld. Counsel states that he will argue this issue before Hon’ble Court.
The instant Appeal has been filed under section 18 of the SARFAESI Act against final order dated 24.06.2022 of DRT, Dehradun in S.A. No. 164/2021. Stay Application (I.A. No. 361/2022), Waiver Application (I.A. No. 360/2022), Urgency Application (I.A. No. 358/2022) and Delay Condonation Application (I.A. No. 359/2022) and have been filed along with the Appeal .
