The Respondent No.4 BSES is the formal party. Respondent No.5 was the brother of Appellant No.1 who was a proforma party, since he did not join the Appellant in instituting the litigation.

In view of the Settlement inter-se the parties, the Appeal is disposed of without prejudice to the rights of the Respondent No.4 and 5, if any, since they are not a party to the Settlement.
