“In view of the above facts, submissions and grounds, it is therefore most respectfully prayed that the order dated 03/05/2010, passed by the court of Sh.D.C.Anand, ADJ, Delhi may kindly be set aside/ quashed and the suit of the appellant/plaintiff for declaration, permanent and mandatory injunction be decided on merits in the interest of justice.

Such other and further order (s) or direction (s) as deemed fit and proper in the facts and circumstances of the case may kindly be passed in favour of the appellant and against the respondents..”
