The matter has been placed before this Court after completion of service before the Joint Registrar (Judicial).

None appears on behalf of respondent no.1/owner despite being served.

This appeal has been filed by appellants/claimants assailing order dated 04^th July 2024, passed by the Motor Accident Claims Tribunal, Karkardooma Courts, Delhi [‘ MACT ’], whereby the claim petition filed by appellants/claimants was dismissed on the ground that it was beyond the limitation period prescribed under Section 166(3) of the Motor Vehicles Act, 1988 [‘ MV Act ’].

The issue of limitation is pending determination before the Supreme Court, and certain interim directions have been passed in this regard in ICICI Lombard General Insurance Co. Ltd. v. Ayiti Navaneetha & Ors., SLP (C) No(s). 8412-8413/2023 , on 04^th November 2025, wherein the Supreme Court

has categorically stated as under:

“ 5. It is made clear that during the pendency of these petitions, the tribunal or the High Courts shall not dismiss the claim petitions on the ground of such petitions as barred by limitation as prescribed under sub-Section (3) or Section 166(3) of the Motor Vehicles Act, 1988. ”

In view of the aforesaid direction, there is no reason as to why the MACT dismissed the claim petition.

Accordingly, the appeal is allowed.

The matter is remanded back to the MACT for consideration on merits.

¶22

List before the MACT on 04^th August 2026.

Copy of the order be also sent to respondent no.1/owner to apprise them of this order and of the remand to the MACT.

The appeal is disposed of, accordingly.

Pending applications, if any, are rendered infructuous.
