This Appeal has been preferred against an interlocutory order dated 19.01.2026 (“ Impugned Order ”) passed in C.M. APPL. 64505/2024 in W.P(C) 3514/2019 whereby the learned Single Judge dismissed CM APPL. 64505/2024 seeking direction while clarifying that the rights and contentions of the Parties are kept open and shall be considered in accordance with law. The Impugned Order also mentions that the endeavour shall be made to dispose of the main Writ Petition on the next date fixed on 10.04.2026. 2. The learned Counsel for the Appellant submits that the Impugned Order fails to consider the extent of abuse of authority by Respondent No. 5 which is evident by engaging a private law firm at public cost to prepare false chargesheets on hit and trial basis and also acted in connivance with a

commission agent and officers junior to the Petitioner for preparing false political complaint. Accordingly, the Appellant has prayed for setting aside of the Impugned Order dated 19.01.2026.

In CM APPL. 64505/2024, the Appellant had sought direction against Respondent No. 1 to alter portfolio of Respondent No. 5 and restraining Respondent No. 5 from exercising control over documentary evidence repository, appointment, promotion, posting and transfers, or case files or legal counsels till the adjudication of her role in the main Writ Petition being W.P.(C) 3514/2019.

After reviewing the Appellant's submissions, the Impugned Order determined that the relief requested in CM APPL. 64505/2024 was not appropriate for adjudication by way of an interim application, particularly given the nature of the dispute and the relief sought in the Writ Petition itself. As a result, the directions requested in CM APPL. 64505/2024 were declined at this stage. However, the Impugned Order expressly preserves the rights and contentions of all parties, which remain open to consideration in accordance with law at the appropriate time.

At the outset, this Appeal is not sustainable against an interlocutory order. Furthermore, the Impugned Order does not exhibit any deficiencies, as the learned Single Judge has appropriately safeguarded the rights and contentions of the Parties for consideration during the hearing of the main Writ Petition. Accordingly, no intervention in this Appeal is warranted.

This Court vide its order dated 13.01.2026 passed in LPA 1220/2024, has already requested the learned Single Judge to expedite the proceedings of the Writ Petition i.e., W.P.(C) 3514/2019 itself.
