The present application has been filed on behalf of the plaintiff for withdrawal of the present suit under Order XXIII Rule 1 read with Section 151 of the Code of Civil Procedure, 1908 (“CPC”).

Learned counsel for the plaintiff submits that the present suit has been filed by the plaintiff seeking declaration and permanent injunction, in respect of various moveable and immoveable properties, based on a Family Settlement dated 26^th November, 2020 and two registered Wills dated 07^th September, 2020 and 07^th December, 2020, respectively. However, she submits that the present application for withdrawal of the suit has been filed by the plaintiff voluntarily, consciously and on his own free will, without any coercion, duress or undue influence.

None appears for the defendants despite advance service.
