This suit is instituted on behalf of the Plaintiffs inter alia seeking a decree of permanent injunction restraining the Defendants and all others acting on their behalf from stocking, selling and offering for sale Disk Clutch Friction, Cam Chain, Kit, Brake, Shoes, Die Cast, Ball Races Kit, Plug Spark, Plug Adaptor, engine oils, lubricants or any other allied/cognate

product bearing the marks “HERO”, / and / and/or any other HERO mark, amounting to infringement and passing off. 2. During the pendency of the proceedings, parties have amicably settled their inter se disputes and executed a Settlement Agreement dated 06.12.2025 before the Delhi High Court Mediation and Conciliation Centre. Court has perused the terms of settlement and finds the same to be lawful.

submits that he has paid the balance sum of Rs. 50,000/- to the counsel for the Plaintiffs during the course of hearing by way of a Demand Draft, as agreed between the parties and nothing further is payable. Counsel for the Plaintiffs acknowledges this fact.

The suit is decreed in terms of the settlement between the parties. Settlement Agreement dated 06.12.2025 shall form part of the decree and the terms thereof shall bind the parties thereto.

Registry is directed to draw up the decree sheet.

By order dated 28.03.2025, Court had appointed Local Commissioner to seize and take into custody the impugned goods with a direction to release the goods on superdari to the Plaintiffs. As per the terms of Agreement, Plaintiffs are permitted to destroy the offending goods bearing the impugned marks within four weeks from today. The destruction proceedings will be photographed and an affidavit to this effect along with photographs will be filed by Plaintiffs within two weeks thereafter, with advance copy to counsel for the Defendants.

Suit stands disposed of.

Plaintiffs are held entitled to refund of entire court fees in accordance with the Court Fees Act, 1870.
