This application is jointly filed on behalf of the Plaintiff and the Defendants under Order XXIII Rule 3 read with Section 151 CPC for recording of settlement between the parties.

This suit is instituted on behalf of the Plaintiff inter alia seeking a decree of permanent injunction against the Defendants restraining the Defendants and all others acting on their behalf from manufacturing, packaging, selling, offering for sale, advertisement and dealing in any

manner whatsoever with the impugned mark or any other mark, artistic work, packaging, trade dress identical or deceptively similar to

infringement of the Plaintiff’s trademark and copyright as also passing off, amongst other reliefs.

During the pendency of the suit, parties have settled the disputes amicably and the terms of settlement are incorporated in paragraph 11 of the application.

Court has perused the terms of settlement and finds the same to be lawful. Accordingly, this application is allowed and disposed of, recording the settlement between the parties.
