This suit is instituted on behalf of the Plaintiff seeking a decree of permanent injunction against Defendants No. 1 and 2 restraining them and all other acting on their behalf from offering for service, advertising, offering for sale, adopting, using and/or dealing in any manner with the

trademarks of the Delhi Public School , DPS and logos and

and/or any other mark identical or deceptively similar to the Plaintiff’s trademarks amounting to infringement and further restraining Defendants No. 1 and 2 from representing in any manner that they are connected with the Plaintiff, amongst other reliefs.

During the pendency of the suit on 24.02.2026, learned counsel for Defendants No. 1 and 2 had submitted, on instructions that Defendants had taken a decision to shut down the school and in furtherance of this decision, no admissions have been given for the academic session 2026-2027. Time was sought to file an undertaking in this behalf.

Defendants No. 1 and 2 have filed an affidavit of undertaking dated 24.02.2026 stating therein that the said Defendants had taken a decision to shut down the school permanently, effective from the current session and have not invited applications for the academic session 2026-2027. It is further stated that Defendants had no intend to violate the directions of this Court and will continue to abide by the injunction order passed on 08.12.2025. It is also stated that website of Defendants No. 1 and 2 has been deleted and no such website will be created in future and that Defendants are willing to hand over all documents bearing the impugned marks.

Learned counsel appearing for Defendants No. 1 and 2 submits that Defendants are willing to suffer permanent injunction since the school has been shut down and they have no intent to continue the school with the impugned marks and that they have transitioned to a new name, which fact can be verified from the report of the Local Commissioner, who visited the premises on 10.03.2026.

In light of the affidavit of undertaking filed by Defendants No. 1 and 2, this suit is decreed in favour of the Plaintiff and against Defendants No. 1

and 2 restraining the said Defendants and all others acting on their behalf permanently from running a school using the trademarks of the Plaintiff

Delhi Public School , DPS and logos and , as also any mark

deceptively similar thereto. Defendants No. 1 and 2 are further restrained from representing in any manner that they are connected and/or associated with the Plaintiff.

No other relief is pressed by the Plaintiff.

Registry is directed to draw up the decree sheet.

Suit is disposed of along with pending application.
