This suit is instituted by the Plaintiffs seeking permanent injunction restraining Defendant No. 1 and all others acting on her behalf from using the word MEDANTA and/or any other mark similar/deceptively similar thereto so as to infringe Plaintiffs’ registered trademark MEDANTA and its formative marks, along with other reliefs. By order dated 14.11.2024, ex parte ad interim injunction was granted by the Court restraining Defendant No. 1 and others acting on her behalf from using the word MEDANTA and

any other mark deceptively similar to Plaintiffs’ mark MEDANTA. Local Commissioners were appointed to search and seize all infringing products, including but not limited to label/packaging material and promotional material.

From time to time, Court directed Defendant No. 1 to take steps to ensure compliances with the directions passed on 14.11.2024. A short affidavit dated 13.12.2025 has been filed by Defendant No. 1 stating therein that: (a) Defendant No. 1 has stopped the use of word MEDANTA inter alia for all her businesses including deletion from WhatsApp groups and all customers have been intimated that the business run by her will be known by the name MOSHISHTA AYURVEDA; (b) FSSAI has approved the application of Defendant No. 1 and issued new licence on 27.03.2025, which is valid upto 26.03.2026; and (c) Defendant No. 1 has deleted the earlier Google account and opened a new one in the name of Moshishta Ayurveda and has deleted all photos, videos and logos with the word MEDANTA from the Facebook page and is now running the Facebook page with the name Moshishta Ayurveda and not MEDHSI HERBAL CURE.

Ms. Shyel Trehan, learned Senior Counsel appearing on behalf of the Plaintiffs, on instructions, submits that the Plaintiffs are satisfied with the compliances made by Defendant No. 1, in consonance with affidavit dated 13.12.2025 and decree be passed in terms of paragraph 53(a) and (c) of the plaint and it be directed that Defendant No. 1 shall remain bound by the undertakings given in the affidavits dated 01.08.2025 and 13.12.2025. She further submits that Plaintiffs do not press for damages.

In light of the undertakings given by Defendant No. 1 in the affidavits dated 01.08.2025 and 13.12.2025, the suit is decreed in terms of paragraph

53(a) and (c) of the plaint. Needless to state, Defendant No. 1 shall remain bound by the undertakings given to the Court.

In terms of order dated 06.12.2025, the goods seized by the Local Commissioner bearing the impugned marks were delivered by Defendant No. 1 to the Plaintiffs and admittedly continue to be in the custody of the Plaintiffs. As agreed between the parties, authorized representatives of the Plaintiffs will destroy the goods within a period of four weeks from today, in presence of the representative/counsel of Defendant No. 1, for which advance intimation shall be given in writing to the counsel for Defendant No. 1.

Registry is directed to draw up the decree sheet.

Suit stands disposed of along with pending applications.
