By way of the instant petition, the petitioners seek quashing of FIR bearing no. 138/2024 dated 07.03.2024, registered at Police Station Tigri, South District, New Delhi for the commission of offence punishable under Sections 307/34 of the Indian Penal Code, 1860 (hereafter „ IPC ‟).

The petitioners (except deceased Ram Singh) and respondent nos. 2 to 5 are present before this Court and have been identified by their counsels and concerned Investigating Officer (IO) from Police Station Tigri, South District, New Delhi.

Briefly stated, the facts of the present case are that on 06.03.2024, the alleged incident had taken place on trivial issues between the petitioners and respondents. On the basis of complaint made by respondent no.2, the present FIR was registered against the petitioners. After investigation, the chargesheet and the supplementary chargesheet were filed before the Concerned Court which is pending trial. During pendency of the present case, with the intervention of family and friends, both the parties have settled all their disputes vide Compromise Deed dated 11.12.2024.

The learned counsel appearing on behalf of the petitioners states that petitioner namely Ram Singh has unfortunately passed away. 11. On instructions from the I.O., the learned APP for the State submits that the factum of the death of petitioner Ram Singh has been verified. 12. On a query made by this Court, respondent nos. 2 to 5 who have been identified by the concerned IO, have categorically stated that they have entered into compromise out of their own free will and without any pressure, coercion or threat and have no objection if the present FIR is quashed. 13. In view of the above fact that the parties have amicably resolved their differences of their own free will, without any coercion, no useful purpose

will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing no. 138/2024 dated 07.03.2024, registered at Police Station Tigri, South District, New Delhi for the commission of offence punishable under Sections 307/34 of IPC and all consequential proceedings emanating therefrom are quashed, subject to petitioners depositing cost of Rs. 5,000/- each with the Civil and Sessions Courts Stenographers‟ Association, Delhi, within a period of two weeks from date and a copy of the receipt be also filed with the Registry to show compliance of the order.

In view of the above, the present petition stands disposed of.
