Learned Standing Counsel for the NCB appearing through V.C. submitted that the IO of the case Inspector Rajender Kumar is present in the Court and it has been decided by the Appellant organisation (NCB) to withdraw the appeal, in view of the fact that the Respondent was acquitted in the year 1997 and since 1998, the instant appeal is pending, without any development.

It is further informed that the present whereabouts of the Respondent are also not available with the Appellant thus, in the totality of the circumstances it has been decided by the Appellant organisation i.e. NCB to withdraw all such appeals including the instant appeal.
