This petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [BNSS], praying for a Writ of Habeas Corpus seeking the production of the wife of the petitioner, namely, Ms. Gulafsha Bano.

Ms. Gulafsha Bano has appeared before the Court in person on advance notice of this petition. We have interacted with Ms. Gulafsha Bano as well as the petitioner in chamber.

During the interaction, she stated that, due to certain misunderstandings between the parties, she had left her matrimonial home and had started residing with her parents sometime in December 2025. She further expressed her willingness to reside with the petitioner. The petitioner has also assured the Court that he will not mistreat Ms. Gulafsha Bano in any manner, and shall keep her happy and ensure her well being.

Since Ms. Gulafsha Bano is a major, she is entitled to decide with whom she wishes to reside. Accordingly, she may go along with the petitioner. We have also counselled the parents of Ms. Gulafsha Bano in this regard.

However, keeping in view the nature of the complaint against the petitioner, we direct the SHO, P.S. Bara Hindu Rao, to visit the house of the petitioner once a week for the next one month to ensure that she is safe and sound.

The petition is disposed of in the above terms.
