By virtue of the present petition under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks issuance of a writ of mandamus directing the respondent no.1 to provide her with Police protection against the threats to her life and limb at the hands of respondent no.2/ daughter of the petitioner herein and/ or any other known/ unknown persons.

Learned senior counsel for the petitioner submits that the petitioner is a senior citizen who has been constrained to file the present petition since she is receiving continuous threats, intimidation and physical and mental harassment at the hands of the respondent no.2 in order to pressurise her to sell the property in which the parties are residing and

acquire the proceeds thereof. Further, despite seeking Police assistance on several occasions, no effective action has been taken as she remains in grave danger qua her life, safety and peaceful possession of her property. 3. Learned senior counsel further submits that recently, when the petitioner left her home to attend a family function, respondent no.2 sent her threatening messages through WhatsApp demanding money and stating that if the said demand is not met, she would sell the household articles belonging to her. Under these circumstances, the petitioner is under constant apprehension and has been unable to return to her home.

In the peculiar facts and circumstances involved, issuance of notice is dispensed with to the private respondents. 5. The facts disclose that the petitioner is a senior citizen surviving on her own and is not fully capable of taking care of herself by all means, and is facing threats, that too from her very own daughter who is residing in the very same premises, and due to which she is unable to return to her very own home, this Court deems it appropriate to grant her Police protection.

Accordingly, the present petition is allowed and the petitioner shall be free to get in touch with the SHO (+91 8750870231), SI Anjali (+919315046991), Head/ Beat Constable Vishwajeet (+91 9968980962) or Constable Anirudh (+919971478815) at PS: Mukherjee Nagar, Delhi, if, as and when the need so arises. Needless to say, the SHO, SI and/ or Beat Constable concerned shall take all possible steps to provide adequate assistance and protection, as and when needed to the petitioner, in accordance with law.

jurisdiction of any other PS, she shall apprise about the same and give the complete details including the address to the SHO of the concerned PS within a period of three days from shifting, and the SHO concerned shall also take all possible steps to provide adequate assistance and protection, as and when needed to the petitioner, in accordance with law.

Accordingly, the present petition, alongwith the pending application, is disposed of in the aforesaid terms.
