By the way of the present petition the petitioner is seeking quashing of FIR No. 11/2025 , registered at Police Station EOW VIII, Mandir Marg, Delhi, for the offences punishable under Sections 318(4)/316(5)/61(2) Indian Penal Code,1860 (hereinafter referred to as the ‘IPC’), and all consequential proceedings emanating therefrom on the basis of the settlement arrived at between the parties.

The petitioner and respondents no. 2 are present before this Court and have been identified by their counsel and Investigating Officer.

Brief facts of the case are that the petitioners are accused in FIR No. 11/2025 registered at P.S. EOW-VIII, Mandir Marg, under Sections 318(4), 316(5) and 61(2) BNS, arising from allegations that Petitioner No. 1, while working as an accountant with Respondent No. 2’s company, misappropriated approximately ₹10 crore of company funds. After investigation and filing of the chargesheet, the parties amicably settled their dispute vide MOU dated 06.06.2025.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that he has entered into compromise, vide Settlement Agreements dated 06.06.2025, out of his own free will and without any pressure, coercion or threat. Therefore, he has no objection if the present FIR is quashed.

In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR No. 11/2025 , registered at Police Station EOW VIII, Mandir Marg, Delhi, for the offences punishable under Sections 318(4)/316(5)/61(2) of the IPC, 1860, along with all consequential proceedings emanating therefrom, is hereby quashed. 10.
