Both the petitions, being connected, have been taken up together.

¶20

Petitioners, who are victims in FIR in question, are aggrieved by order whereby concerned respondent has been released on bail. In CRL.M.C.5463/2023, the bail order is dated 31.07.2023 whereby respondent Anil Kumar Saha has been released on bail and in CRL.M.C.6719/2023, the bail order is dated 11.09.2023 whereby respondent Aunirban Saha has been released on bail.

The abovesaid petitions are pending for quite some time and when asked, it was, in all fairness, apprised by learned Senior Counsel for the petitioners, learned Addl. P.P. for the State and learned counsel for respondent No.2 that the matter is still at the stage of ascertainment of charges.

Both the sides have assured that they would extend their best cooperation to the learned Trial Court at the time of hearing of arguments on charge.

Learned Senior Counsel for the petitioners, on instructions, while reserving all his rights and contentions and, particularly, in view of the fact that considerable time has elapsed already, does not press the present petitions. He, however, states that let learned Trial Court be requested to expedite the ascertainment of charges and let charges be decided, without being prejudiced by the observations appearing in the bail orders.

In view of the above, both the abovesaid petitions are disposed of, as not pressed.

All rights and contentions of the parties are reserved.

Learned Trial Court is also requested to give requisite priority to the abovesaid matter and to decide the charges as expeditiously as possible,

without being influenced by observations appearing in bail orders.

Needless to say, if anything related to investigation is still pending, suitable directions would be given by the learned Trial Court to the concerned Investigating Officer so that there is no delay in concluding investigation. 10. Learned Senior Counsel for the petitioners submits that his abovesaid statement may not be construed as if he has no objection to grant of bail to the other co-accused. Since it is apprised that bail application of other accused is pending adjudication, learned Trial Court shall consider the abovesaid application, without being influenced by the present order.

The petitions are disposed of in aforesaid terms.

Pending applications also stand disposed of.
