The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’] seeking quashing of FIR No. 149/2020 , registered at Police Station Punjabi Bagh, West District, Delhi, under Sections 498A and 406 read with Section 34 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’], and all consequential proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the parties vide Memorandum of Understanding [MoU] dated 17.10.2023.

The Petitioners are present before this Court and Respondent No.2 has appeared before this Court through video conferencing [VC] and all have been duly identified by their respective learned counsels as well as the concerned Investigating Officer [IO].

Briefly stated, petitioner No. 1 and respondent No. 2 were married on 11.10.2011 and two daughters were born out of the wedlock. Owing to matrimonial differences, the parties started residing separately in the year 2018, whereafter respondent No. 2 lodged a complaint before the CAW Cell, pursuant to which FIR No. 149/2020 dated 22.02.2020 came to be registered against the petitioners under Sections 498A and 406 read with Section 34 of IPC. During the pendency of the proceedings, petitioner No. 1 and respondent No. 2 amicably resolved their disputes vide Memorandum of understanding [MoU] dated 17.10.2023, and their marriage was subsequently dissolved by a decree of divorce by mutual consent dated 09.10.2024.

On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that she entered into the Deed of Settlement/MOU dated 17.10.2023 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that she has no objection if the aforementioned FIR is quashed. 7. In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat and their marriage also stands dissolved by a decree of divorce via mutual consent, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is

of the view that the interest of justice would be served by bringing the proceedings to an end. Accordingly, FIR No. 149/2020, registered at Police Station Punjabi Bagh, West District, Delhi, under Sections 406, 498A and 34 IPC, and all proceedings arising therefrom, are liable to be quashed.

Accordingly, FIR No. 149/2020 , registered at Police Station Punjabi Bagh, West District, Delhi, for offences punishable under Sections 498A and 406 read with Section 34 of IPC, and all consequential proceedings emanating therefrom, are hereby quashed.

Therefore, the present petition is allowed and thereby, disposed of.
