The present petition has been filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 [hereinafter referred to as ‘BNSS’] seeking quashing of FIR No. 122/2021 , registered at Police Station Punjabi Bagh, West District, Delhi, under Section 354 of the Indian Penal Code, 1860 [hereinafter referred to as ‘IPC’] read with Section 10 of the Protection of Children from Sexual Offences Act, 2012 [hereinafter referred to as ‘POCSO Act’], and all consequential proceedings emanating therefrom, on the basis of an amicable settlement arrived at between the parties vide Memorandum of

The Petitioner is present before this Court and Respondent No.2, who has appeared before this Court through video conferencing [VC]. Both have been duly identified by their respective learned counsels as well as the concerned Investigating Officer [IO].

Briefly stated, the petitioner and respondent No. 2 were married on 11.10.2011 and two daughters were born out of the wedlock. Owing to matrimonial differences, the parties started residing separately in the year 2018. Thereafter, FIR No. 122/2021 came to be registered against the petitioner under Section 354 IPC read with Section 10 of the POCSO Act on allegations concerning inappropriate touching of one of the minor daughters. During the pendency of the proceedings, the petitioner and respondent No. 2 amicably resolved their disputes vide MoU dated 17.10.2023.

On a query made by this Court, respondent No. 2, who has been duly identified by the IO, has stated that she entered into the MoU dated 17.10.2023 of her own free will and without any pressure, coercion, undue influence or threat. She has further stated that she has no objection if the aforementioned FIR is quashed.

In view of the above, since the parties have amicably resolved their differences of their own free will and without any pressure, coercion, undue influence or threat, no useful purpose would be served by continuing the proceedings. Rather, continuation of the proceedings may only give rise to further acrimony between the parties. In these circumstances, this Court is of the view that the interest of justice would be served by bringing the

Accordingly, FIR No. 122/2021 , registered at Police Station Punjabi Bagh, West District, Delhi, for offences punishable under Section 354 of the IPC read with Section 10 of POCSO Act and all consequential proceedings emanating therefrom, are hereby quashed.

Therefore, the present petition is allowed and disposed of.
