The present petition seeks quashing of FIR No.318/2020 registered at Police Station New Ashok Nagar, Delhi under Sections 420/468/471 of the Indian Penal Code, 1860 [“ IPC ”] and all consequential proceedings arising therefrom, which are presently pending before the Court of the learned ACJM, East District, Karkardooma Courts, Delhi.

It is the case of the petitioners that FIR No.676/2014 had already been registered against them at Police Station New Ashok Nagar, wherein allegations pertaining to forgery and fabrication of documents in respect of the tenanted property were under investigation and a charge-sheet had already been filed.

petitioners had fraudulently obtained installation of a fresh electricity meter in the same property in the name of petitioner no.2, pursuant to which the impugned FIR No.318/2020 came to be registered. According to the petitioners, the allegations forming the subject matter of the impugned FIR arise out of the same transaction and ought to have been investigated in FIR No.676/2014 itself. It is, therefore, contended that the registration of the second FIR is not legally sustainable.

Learned counsel for the petitioners submits that investigation in the impugned FIR has also culminated in filing of a charge-sheet and the matter is presently pending before the learned ACJM, East District, Karkardooma Courts, Delhi.

In view of the aforesaid, this Court deems it appropriate to leave it open to the petitioners to raise all their grievances before the learned Trial Court at the stage of consideration on charge. The learned Trial Court shall consider the submissions of the petitioners, including their plea with respect to the maintainability of the impugned FIR, and pass an appropriate order in accordance with law.

If the petitioners’ grievance is not mitigated, the petitioners shall be at liberty to take appropriate recourse in accordance with law.

All rights and contentions are left open.

With the aforesaid observations, at this stage, the petition stands disposed of.
