Delhi High Court (Saurabh Banerjee, J.), CRL.M.C. 498/2026 with CRL.M.A. 2002/2026, order dated 20.01.2026: Petition under Section 528 BNSS, 2023 (erstwhile Section 482 Cr.P.C., 1973) by Ravi & Ors. seeking quashing of FIR No.729/2019 dated 22.12.2019, registered under Sections 323/341/506/34 IPC at PS Baba Haridas Nagar, Delhi, and all proceedings emanating therefrom, in view of a Settlement Agreement dated 11.08.2025 reached between the father of petitioner no.4 and respondent nos.2 and 3 before the Mediation Centre, Dwarka Courts, New Delhi. The learned APP for the State raised no objection; respondent nos.2 and 3 affirmed the settlement, stated the disputes were voluntarily settled and consented to quashing; identities were verified by the Investigating Officer. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ) [erstwhile Section 482 of the Code of Criminal Procedure, 1973 ( Cr.P.C. ), the petitioners seek quashing of FIR No.729/2019 dated 22.12.2019 registered under Sections 323/341/506/34 of the Indian Penal Code, 1860 ( IPC ) at PS.: Baba Haridas Nagar, Delhi, and all proceedings emanating therefrom, in view of the Settlement Agreement dated 11.08.2025 arrived at between the father of petitioner no.4 and the respondent nos.2 and 3, before the Mediation Centre, Dwarka Courts, New Delhi.

The present petition is also accompanied by the said Settlement Agreement dated 11.08.2025 [ Annexure P2 ] alongwith the respective proofs of the identities of the parties.

Respondent nos.2 and 3 also accepts notice. Respondent nos.2 and 3 affirm the Settlement Agreement dated 11.08.2025 and submit that they have voluntarily settled all disputes with the petitioners. It was further stated that they do not wish to pursue the criminal proceedings against the petitioners and have no objection to the quashing of the present FIR.

Further, the petitioners and the respondent no.2 & 3, as well as their credentials on record, have all been identified by the Investigating Officer. 7. In view of the fact that a Settlement has already been arrived at between the father of petitioner no.4 and the respondent nos.2 and 3, the parties shall remain bound by all the terms and conditions contained therein. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58 , Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466 , this Court is of the opinion that continuation of the aforesaid FIR No.729/2019 dated 22.12.2019 will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.729/2019 dated 22.12.2019 registered under Sections 323/341/506/34 of the IPC at PS.: Baba Haridas Nagar, Delhi and all proceedings emanating therefrom are hereby quashed. 9. Accordingly, the petition alongwith pending application is disposed of in the aforesaid terms.
