The present petition seeks quashing of FIR No. 829/2023 dated 09.12.2023, registered at Police Station Alipur, Delhi for commission of offences under Sections 498A/406/34 IPC, along with all consequential proceedings emanating therefrom, on the basis of compromise arrived at between the parties.

The FIR in question was registered on the basis of the complaint of Kajal (respondent No.2 herein).

The complaint was against her husband and his relatives.

She got married to petitioner No.1 Sh. Rajkumar on 02.03.2020 and in her complaint, she specified that there was demand of dowry and that she was treated with cruelty.

The chargesheet has already been filed in which there are six accused persons i.e. husband Sh. Rajkumar, his parents and three sisters.

The matter has now been amicably settled between the parties.

During pendency of the proceedings before learned Judge, Family Court, with the efforts of the concerned Counsellor, the matter got settled. The terms of settlement are duly recorded in such Settlement Deed dated 06.11.2024. In terms of settlement, the parties have already obtained “ divorce by way of mutual consent ” Copy of such order dated 13.05.2025 has also been placed on record whereby the marriage in question has been dissolved under Section 13B(2) of Hindu Marriage Act through a decree of divorce by mutual consent.

As per settlement, the husband has agreed to pay a total sum of Rs.1,00,000/- as full and final settlement to his wife towards stridhan , dowry and maintenance (past, present and future). A sum of Rs.70,000/- has already been received by the complainant and the last installment of Rs.30,000/- has been received by her in Court by way of a draft drawn on Canara Bank dated 02.12.2025.

Learned counsel for respondent No.2 is also present and submits that the matter has already been amicably settled and today, after receiving the last instalment of the settlement amount, nothing is left between the parties.

Respondent No.2 is present in person. The Court has made inquiries from her also. She also submits that the matter has been amicably settled and since there is already a divorce between them, she does not want to pursue with her present criminal case. She submits that he has voluntarily and without any coercion or duress, entered into settlement and does not wish to pursue the matter any further and supports the prayer for quashing of the FIR. She also submits that she has already moved on and has married again.

In view of the settlement arrived between the parties, continuing with criminal proceedings would serve no useful purpose especially when dispute does not involve any public interest or interest of the society at large. In any case, even the complainant does not wish to press any charges against the petitioners. 13. Accordingly, exercising the inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the FIR instant. 14. Consequently, FIR No.829/2023 dated 09.12.2023, registered at Police Station Alipur, for the alleged offences under Sections 498A/406/34 IPC, along with all consequential proceedings emanating therefrom, is hereby quashed. 15. The petition stands disposed of in aforesaid terms.
