By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioners seek quashing of FIR No.879/2025 dated 26.12.2025 registered under Sections 115(2)/126(2)/117(2)/351(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 ( BNS ) at PS: Narela, and all proceedings emanating therefrom since the petitioners and the respondent no.2 have settled all their disputes. 2. The present petition is accompanied by the NOC of the respondent no.2 [Pages 29-30] alongwith the respective proofs of identity of the petitioners and the respondent no.2.

Learned APP for the State accepts notice, and submits that he has no objection to the quashing of the aforesaid FIR No.879/2025 dated 26.12.2025.

Respondent no.2, appearing through video conferencing, also accepts notice and affirms the settlement arrived at inter se the parties. He submits that he has voluntarily settled all disputes with the petitioners, and does not wish to pursue the criminal proceedings against the petitioners. Further, that he has no objection to the quashing of the aforesaid FIR No.879/2025 dated 26.12.2025.

The petitioners, present in Court, as also the respondent no.2, appearing through video conferencing, have been identified by the IO, as also their credentials have been verified.

In view of the fact that a settlement has already been arrived at between the petitioners and respondent no.2, as such, following the law laid down by the Hon’ble Supreme Court in Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466 , this Court is of the opinion that continuation of the aforesaid FIR No.879/2025 dated 26.12.2025 will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.879/2025 dated 26.12.2025 registered under Sections 115(2)/126(2)/117(2)/351(2)/ 3(5) of the BNS at PS: Narela, and all proceedings emanating therefrom are hereby quashed.
