By way of the present petition, the Petitioner is seeking quashing of FIR No. 266/2022 , registered at Police Station Kalyanpuri, Delhi, under Sections 498A/406/34 of the Indian Penal Code, 1860 (hereinafter referred to as the ‘IPC’ ) and all consequential proceedings emanating therefrom, on the basis of the settlement arrived at between the parties.

Issue notice. Learned APP accepts notice on behalf of the State.

All the Petitioners and Respondent No.2 are present before this Court. Petitioner No.2 has appeared through video conferencing. Respondent No.2 has appeared on advance notice and has been duly identified by the Investigating Officer (IO) concerned, Police Station Kalyanpuri, Delhi.

and Respondent No.2 was solemnized on 31.10.2017 according to Hindu rites and ceremonies. Out of the wedlock, one female child was born. Owing to matrimonial disputes, Respondent No.2 lodged a complaint, pursuant to which the present FIR came to be registered against the Petitioners. Thereafter, the parties amicably settled all their disputes before the Delhi Mediation Centre, Karkardooma Courts, Delhi vide Settlement Deed dated 03.12.2022. Subsequently, the marriage between the parties was dissolved by a decree of divorce by mutual consent on 31.10.2023.

Learned counsel for the Petitioners submits that, in terms of the settlement, the balance settlement amount of Rs.1,00,000/-, payable at the time of quashing, has been paid to Respondent No.2 today. Out of the said amount, a sum of Rs.10,000/- has been paid in cash and the remaining Rs.90,000/- has been paid by way of Demand Draft bearing No. 158132, which has been handed over to Respondent No.2 in Court today. It is submitted that with the aforesaid payment, the entire settlement stands satisfied and nothing further remains payable by either party.

On a query made by this Court, Respondent No.2, who has been duly identified by the IO, categorically states that she has entered into the settlement out of her own free will, without any force, coercion or undue influence. She further states that she has received the entire settled amount and has no surviving claim whatsoever against the Petitioners. She has no objection if the present FIR and all consequential proceedings emanating therefrom are quashed.

In view of the above, since the parties have amicably resolved all their disputes of their own free will, the marriage already stands dissolved by a decree of divorce by mutual consent, the entire settlement amount has been

paid, and Respondent No.2 has no objection to the quashing of the FIR, no useful purpose would be served by continuing the criminal proceedings. Rather, continuation thereof would only perpetuate unnecessary litigation between the parties. There is no legal impediment to quashing the FIR in the facts and circumstances of the present case.

Accordingly, FIR No. 266/2022, registered at Police Station Kalyanpuri, Delhi, under Sections 498A/406/34 IPC and all consequential proceedings emanating therefrom are hereby quashed.

The present petition, along with pending application(s), if any, stands disposed of.
