By way of the present writ petition filed under Articles 226/227 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner inter alia seeks a direction to the learned trial court to expedite trial in case FIR No.142/2013 dated 02.08.2013 registered under sections 147/148/380/452/34 of the Indian Penal Code, 1860 at P.S.: Kotwali, North Delhi.

As per the record, chargesheet in the matter was filed on 26.05.2015, in which an allegation under section 411 IPC was added; and a supplementary chargesheet was also filed on 07.10.2020, wherein an allegation under section 380 IPC was also added. 08 witnesses have

been cited by the prosecution in the chargesheet; and 06 witnesses have been cited in the supplementary chargesheet.

The petitioner is the Mahant of a temple and the genesis of the matter is a dispute in relation to temple property. The petitioner is now stated to be about 80 years old and is stated to be suffering from throat cancer. It is stated that the petitioner’s wife, who was the other complainant, has passed away and 04 of the accused persons have also passed away during pendency of the proceedings.

Considering the evident delay in the trial court proceedings, vide last order dated 18.12.2025 a status report was called-for from the concerned learned trial court.

Status report dated 06.01.2026 has been received pursuant to that direction, in which the learned trial court has set-out the various dates on which the matter has been taken-up.

As per the status report received, the matter was to be taken-up last on 11.01.2026, for arguments on charge. Arguments are stated to have been concluded.

The matter is now listed before the learned trial court next on 21.01.2026, for orders on charge.

Clearly, there is no justification for such inordinate delay in conclusion of the trial, even if some explanations are forthcoming.

Learned counsel for the petitioner submits, that at the very least, the statement of the complainant/petitioner No.1 be recorded forthwith, since he is seriously unwell.

Learned ASC appearing for the State leaves it to the court to pass appropriate orders.

In view of the prayer made, it is not considered necessary to issue notice to the private respondents, who are the accused persons in the case.

Upon a conspectus of the foregoing facts and circumstances, the present petition is disposed-of, directing the learned trial court to conclude the trial in the matter as expeditiously as possible , and in any event within 08 months from the next date of hearing before the trial court i.e., 21.01.2026.

Additionally, the learned trial court is mandated to conclude the deposition i.e. , examination-in-chief, cross examination and reexamination (if any) of PW-1 i.e., the petitioner positively within the month of February-March 2026.

Pending applications, if any, also stand disposed-of.

Let a copy of this order be forwarded to the concerned court through the Principal District & Sessions Judge, Central District, Tis Hazari Courts, Delhi.
