Petitioners, led by husband Anuj Gupta, sought quashing of FIR No. 1136/2023, Police Station Rani Bagh, Delhi, registered on the complaint of respondent no. 2 (wife) under Sections 498A/406/377/34 IPC, following a marriage solemnized on 06.07.2022 and separation from 28.01.2023. During pendency of trial the parties executed a Memorandum of Understanding dated 04.02.2026. Respondent no. 2, identified by the Investigating Officer, affirmed before the Court that the compromise was entered out of her own free will without pressure, coercion or threat, that the entire settlement amount had been received, and that she had no objection to quashing. Holding that continuation of proceedings would serve no useful purpose and would only create further acrimony, and that no legal impediment existed, the Court quashed the FIR and all consequent proceedings and disposed of the petition.

By way of the present petition, the petitioners seek quashing of the FIR bearing No. 1136/2023, registered at Police Station Rani Bagh, Delhi, for the commission of offence punishable under Sections 498A/406/377/34 of the Indian Penal Code, 1860 (hereafter ‘ IPC ') and all proceedings emanating therefrom.

Brief facts of the case are that the marriage between petitioner no. 1 and respondent no. 2 was solemnized on 06.07.2022 in accordance with Hindu rites and ceremonies. It is stated that no child was born out of the said wedlock. It is stated that due to temperamental differences which had arisen between the petitioners and the respondent no. 2, they started living separately since 28.01.2023. Further, upon a complaint filed by respondent no. 2, the present FIR was registered against the petitioners. However, it is stated that during pendency of the trial, both the parties have now amicably settled their disputes vide Memorandum of Understanding dated 04.02.2026.

On a query made by this Court, respondent no. 2 who has been identified by the IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat and that she has received the entire amount which was due towards the settlement arrived at between the parties. Therefore, she has no objection, if the present FIR is quashed. 7. In view of the above, that the parties have amicably resolved their differences out of their own free will, and without any pressure, coercion, and threat, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.
