By way of the present petition filed under Article 226 of Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners and complainants/respondent Nos. 2 and 3, jointly seek quashing of case FIR No. 642/2024 dated 03.12.2024 registered under sections 110/3(5) of the Bharatiya Nyaya Sanhita, 2023 (‘BNS’) at P.S.: Dayal Pur, Delhi.

The petition is premised on Memorandum of Understanding/Compromise Deed dated 14.10.2025, whereby the

petitioners and respondents Nos. 2 and 3 have resolved the matter amicably.

The petition is also supported by affidavits of the petitioners and of respondents Nos. 2 and 3, alongwith proof of their IDs.

Pursuant to last order dated 17.11.2025, learned ASC appearing for the State has handed-up status report dated 16.02.2026, which is taken on record.

Since the matter concerned an allegation inter-alia under section 109(2) of BNS, the court has also perused the MLC of the injured persons from the case file.

The court has interacted with the respondents Nos.2 and 3, as also with petitioners, who have confirmed that they have now resolved the matter and Memorandum of Understanding/Compromise Deed dated 14.10.2025 has been signed by them closing all issues amicably. Since the parties are the neighbours, they now wish to live in peace and harmony going forward.

Mr. Sanjeev Bhandari, ASC, learned ASC (Criminal) confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be

quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.

While allowing the petition however, this court considers it appropriate, that by way of atonement, the petitioners shall pay costs Rs. 25,000/- each to the ' Very Special Arts India ', Plot No. 3 Institutional Area, Nelson Mandela Marg, Vasant Kunj, New Delhi, within 04 weeks.

Subject to the aforesaid condition, FIR No. 642/2024 dated 03.12.2024 registered under sections 110/3(5) at P.S.: Dayal Pur, Delhi. is quashed. All proceedings arising therefrom also stand closed.
