Petitioner, whose name was shown in Column No.12 of charge-sheet, has been directed to be summoned by the learned Trial Court for commission of offences under Sections 406, 420 and 120B IPC vide order dated 24.11.2025.

The abovesaid order has been challenged by the petitioner by filing a Revision Petition which has been registered as Cr. Rev. No.229/2026 and when such Revision Petition was taken up by the learned Court of Sessions on 22.04.2026, the matter was adjourned to 06.08.2026. Learned Revisional Court, however, declined to stay the proceedings pending before the learned Trial Court.

The present petition takes exception to the abovesaid order dated 22.04.2026 to the extent it declines stays.

Learned counsel for the petitioner submits that it was a fit case where the proceedings should have been stayed.

Learned Addl. P.P for the State appears on advance notice and learned counsel for respondent No.2 has joined the proceedings through video-conferencing .

However, this Court does not find any real requirement of interfering with the above said order and to pass any order, particularly when the matter is already pending consideration before the learned Revisional Court.

After hearing arguments for some time, learned counsel for the petitioner, without prejudice to his rights and contentions, does not press the present petitioner. He submits that the next date of hearing before the learned Trial Court is 12.05.2026 and he would move application before the learned Trial Court afresh or before the learned Revisional Court seeking exemption from his personal appearance till the disposal of the Revision Petition filed by him and also for preponment of the date in such Revision.

Petitioner is always at liberty to file any such application and it will be entirely upto the abovesaid learned Court(s) to consider the same and to dispose those of, in accordance with law, after giving due opportunity of hearing to both the sides.

The petition is, accordingly, disposed of as not pressed in aforesaid terms.
