By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioners seek quashing of case FIR No.328/2016 dated 11.08.2016 registered under sections 354/354B/509/506/341/34 of the Indian Penal Code, 1860 (‘IPC’) at P.S.: Jafrabad, North-East Delhi.

The petition is premised on Compromise-cum-Settlement Agreement dated 24.02.2026, whereby the petitioners and respondent No.2 have resolved the matter amicably.

The petition is also supported by affidavits of the petitioners and of respondent No. 2, alongwith proof of their IDs.

Petitioners Nos.1 and 2 are present in court. Petitioners Nos.3 and 4, being female members of the family, are stated to be residing outside Delhi, and have therefore joined the proceedings via videoconferencing. Respondent No.2 has also joined the proceedings via video-conferencing; and her brother is present in court. The court is

informed that respondent No.2 has recently got married and has relocated outside Delhi. The credentials of the parties have been verified and they have also been identified by their respective counsel.

1. The court has interacted with respondent No.2. She confirms that she has settled the matter with the petitioners; and does not wish to pursue the subject FIR any further.

As narrated in para 2.9 of the petition, the petitioners have already remitted to respondent No.2 the sum of Rs.30,000/- out of the total settlement amount of Rs.40,000/-; and the balance Rs.10,000/- has been remitted to respondent No.2’s brother, who has received the same on respondent No.2’s behalf.

Ms. Kiran Bairwa, learned APP confirms that the State has no objection to the subject FIR being quashed.

In the circumstances, in line with the law laid down by the Supreme Court in Gian Singh vs. State of Punjab & Anr. reported as (2012) 10 SCC 303 as also in Narinder Singh & Ors. vs. State of Punjab & Anr. reported as (2014) 6 SCC 466, this court sees no reason why the subject FIR and all proceedings emanating therefrom should not be quashed. This court is of the view that in light of the settlement between the contesting parties, continuing with the subject FIR and all subsequent proceedings would be an exercise in futility and would not be conducive to peace and harmony between the parties.

Accordingly, case FIR No.328/2016 dated 11.08.2016 registered under sections 354/354B/509/506/341/34 of the IPC at P.S.: Jafrabad, NorthEast Delhi is quashed. All proceedings arising therefrom also stand closed.

This order shall however be subject to the petitioners paying costs of Rs. 7500/- each to the ' Very Special Arts India ', Plot No. 3 Institutional Area, Nelson Mandela Marg, Vasant Kunj, New Delhi, within 02 weeks. Proof of payment of costs be placed on record within 01 week thereafter.

The Registry is directed to verify compliance; and to bring to the notice of this court any default in respect thereof.

The petition stands disposed-of in the above terms.

Pending applications, if any, also stand disposed-of.
