By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of FIR No.446/2024 dated 28.11.2024 registered at PS: Jamia Nagar, South-East Delhi under Sections 281/125(a)/125(b) of the Bharatiya Nyaya Sanhita, 2023 ( BNS ) and all proceedings emanating therefrom, in view of the Settlement Deed dated 16.02.2026 [ Annexure P3 ] arrived at between the petitioner and the respondent nos.2 and 3 before the Mediation Centre,

Learned APP for the State accepts notice and submits that he has no objection to the quashing of the aforesaid FIR.

Respondent nos.2 and 3, present in Court, also accept notice and affirm the terms of the aforesaid Settlement Deed dated 16.02.2026, whereby the petitioner has agreed to pay settlement amount of Rs.70,000/by way of a Demand Draft dated 27.03.2026 being 694164 (Indian Bank, Jamia Milia Islamia, Delhi), handed over in Court to the respondent nos.2 and 3, towards damages to them, and submit that they have no objection to the quashing of the aforesaid FIR.

The petitioner and the respondent nos.2 and 3, present in Court, as well as their credentials, as on record, have been identified by the Investigating Officer.

The present petition is accompanied by a settlement already arrived voluntarily between the petitioner and respondent nos.2 and 3 as also their respective affidavit(s) to the said effect. In view thereof, the parties shall remain bound by all the terms and conditions of the settlement arrived inter se themselves. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58 , Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466 , since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR against the petitioner will be an exercise in futility.

Thus, the present petition is allowed and FIR No.446/2024 dated 28.11.2024 registered at PS: Jamia Nagar, South-East Delhi under Sections 281/125(a)/125(b) of the BNS and all proceedings emanating therefrom are hereby quashed.

Accordingly, the present petition, alongwith the pending application, is disposed of in the aforesaid terms.
