The present appeal has been filed by the Appellant under Section 21(4) of the National Investigation Agency Act, 2008, inter alia , assailing the impugned order dated 7th November, 2025 passed by the ld. ASJ-03, N.D.D.,

Patiala House Courts, New Delhi in connection with FIR No. RC No. 38/2022/NIA/DLI . Vide the impugned order, the bail application of the Appellant has been rejected.

It is submitted by Mr. Tyagi, ld. SPP that the present prayer for bail has become stale in view of the fact that the order on charge is to be pronounced on 30^th July, 2026 by the ld. Trial Court.

Under these circumstances, ld. Counsel for the Appellant submits that he wishes to withdraw the present appeal with liberty to approach afresh the ld. Trial Court for seeking bail.

Accordingly, the appeal is dismissed as withdrawn with liberty to the Appellant to approach the ld. Trial Court for bail in view of the change in factual circumstances, after the pronouncement of the order on charge.

Needless to add, this Court has not considered the merits of the case. If such an application for bail is filed, the same shall be considered and disposed of within a period of four weeks from the date of filing of the application.
