High Court of Delhi (Saurabh Banerjee, J.), order dated 02.04.2026 in CRL.M.C. 2465/2026 (with pending application CRL.M.A. 10051/2026): Petition under Section 528 of the BNSS, 2023 by Akshay Lakra & Anr. seeking quashing of FIR No.0084/2025 dated 24.07.2025, PS.: Barakhamba Road, Delhi, registered under Sections 109(1)/140(3)/62/3(5) of the BNS, 2023, and all proceedings emanating therefrom, allowed on the basis of a Settlement Agreement dated 24.03.2026 (Annexure P3) voluntarily arrived at between the petitioners and respondent no.2, supported by affidavits and proofs of identity. Learned APP for the State and respondent no.2 raised no objection; the Investigating Officer identified the parties and their credentials in Court. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioners seek quashing of FIR No.0084/2025 dated 24.07.2025 registered at PS.: Barakhamba Road, Delhi under Sections 109(1)/140(3)/62/3(5) of the Bharatiya Nyaya Sanhita, 2023 ( BNS ) and all proceedings emanating therefrom, in view of the Settlement Agreement dated 24.03.2026 [ Annexure P3 ] arrived between the petitioners and the respondent no.2, which is accompanied by their respective proofs of identities.

Issue notice. Learned APP for the State accepts notice and submits that he has no objection to the quashing of the aforesaid FIR.

Respondent no.2, present in Court, also accepts notice and submits that he has no objection to the quashing of the aforesaid FIR in view of the Settlement Agreement dated 24.03.2026.

Facts disclose that a settlement has already been arrived voluntarily between the petitioners and the respondent no.2 as also the present petition is accompanied by their respective affidavit(s) to the said effect. In view thereof, the they shall remain bound by all the terms and conditions of the settlement arrived inter se themselves. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr .: (2013) 4 SCC 58 , Gian Singh vs. State of Punjab & Anr. : (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. : (2014) 6 SCC 466 , since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR against the petitioners will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.0084/2025 dated 24.07.2025 registered at PS.: Barakhamba Road, Delhi under Sections 109(1)/140(3)/62/3(5) of the BNS and all proceedings emanating therefrom are hereby quashed. 7. As such, the present petition, alongwith pending application, is disposed of in the aforesaid terms.
