By virtue of the present petition Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner seeks quashing of FIR No.589/2024 dated 09.11.2024 registered at PS: Janakpuri under Sections 281/125(A) of the Bharatiya Nyaya Sanhita, 2023 ( BNS ) and all proceedings emanating therefrom, in view of Settlement dated 18.03.2026 ( Annexure E ) arrived at between the petitioner and the respondent no.2, which is accompanied by their respective proofs of identity.

Learned counsel for the respondent nos.3 and 4 has handed over a copy of the No Objection Certificate of respondent nos.3 and 4, which is taken on record.

Issue notice. Learned APP for State accepts notice and submits that he has no objection to the quashing of the aforesaid FIR.

Respondent nos.2 and 4, present in Court alongwith respondent no.3 wife of late Mr. Rajkumar, who, also accept notice and affirms the terms of the aforesaid Settlement dated 18.03.2026, by virtue whereof two Demand Drafts being DD No.018594 dated 21.05.2026 and DD No.018595 dated 21.05.2026 (Canara Bank) of Rs.1,00,000/- each have been handed over to them today as full and final settlement of all his present, past and future claims, etc. They further submit that they have no objection to the quashing of the aforesaid FIR.

The petitioner and the respondent nos.2 and 4 and the respondent no.3 wife of late Mr. Rajkumar, present in Court, as well as their credentials as on record, have been identified by the IO. 6. Facts disclose that a settlement has already been arrived voluntarily between the petitioner and the respondent nos.2 and 4 and respondent no.3 wife of late Mr. Rajkumar and the present petition is accompanied by their respective affidavit(s) qua the said effect. In view thereof, they shall remain bound by all the terms and conditions of the settlement arrived inter se themselves. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr.: (2013) 4 SCC 58 , Gian Singh vs. State of Punjab & Anr.: (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr.: (2014) 6 SCC 466 , since there is nothing left to corroborate and prove the case of the prosecution, continuation of the aforesaid FIR against the petitioner will be an exercise in futility.

Thus, the present petition is allowed and FIR No.589/2024 dated 09.11.2024 registered at PS: Janakpuri under Sections 281/125(A) BNS and all proceedings emanating therefrom are hereby quashed.
