By virtue of the present petition under Article 226 of the Constitution of India under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner inter alia seeks issuance of writ in the nature of mandamus directing the respondent to extend furlough granted to the petitioner vide order/ letter/ communication dated 18.06.2026 of the Director General of Prisons, Prison Headquarters, Tihar in FIR No.447/1996 under Sections 302/34 IPC at PS: Bhajanpura, Delhi for a further period of two weeks with effect from 24.07.2026.

Learned counsel for the petitioner submits that pursuant to the demise of the wife of the petitioner on 13.07.2026, the petitioner had made

request to the Jail Authorities for extension of furlough with effect from 25.07.2026 vide request letter dated 16.07.2026 sent by courier. He further submits that, in view of the said exigent condition, the petitioner cannot await the decision of the competent authority, since the same may take considerable time. As such, under these circumstances, the petitioner is before this Court.

Issue notice. Learned ASC accepts notice. 6. Though learned ASC submits that the receipt of the aforesaid request letter is not ascertained, nonetheless, she submits that the present petition shall be treated as a representation on behalf of the petitioner, which, shall be decided as expeditiously as possible, preferably within a period of one week upon verification.

In view of the aforesaid, the present petition is disposed of with a direction that the present petition be treated as representation of the petitioner and shall be decided by the Competent Authority within the aforesaid period of one week .

However, the furlough granted to the petitioner vide order/ letter/ communication dated 18.06.2026 of the Director General of Prisons, Prison Headquarters, Tihar in FIR No.447/1996 under Sections 302/34 IPC at PS: Bhajanpura, Delhi is extended till the decision of the Competent Authority on the aforesaid representation of the petitioner.

The petition is accordingly disposed of in the aforesaid terms.
