Ankit Rawal Alias Ankit & Ors. Vs State of Delhi NCT of Delhi & Anr.

By way of the present petition, the petitioners seek quashing of FIR bearing no. 292/2018, registered at Police Station Rajouri Garden, Delhi for commission of offence punishable under Sections 419/420/468/471/120B of Indian Penal Code, 1860 (hereafter ‘ IPC ’).

All the petitioners and respondent nos. 2 are present before this Court and have been identified by their counsel and Investigating Officer (IO) from Police Station Rajouri Garden, Delhi.

Brief facts of the present case are that on 11.05.2018, on the complaint of respondent no. 2, the present FIR was registered at the concerned Police Station against the petitioners. On 12.05.2018, petitioners were arrested and sent to judicial custody. During pendency of the bail

applications of the petitioners, both the parties had amicably settled their disputes vide Memorandum of Understanding (MoU) dated 08.06.2018.

On a query made by this Court, Authorized Representative of respondent no.2, who has been identified by the IO, has categorically stated that respondent no. 2 has entered into compromise out of its own free will and without any pressure, coercion or threat. It is also stated by AR of respondent no.2 that the entire dispute has been amicably settled between them vide the aforesaid MOU. Authorized Representative of respondent nos.2 further states that he has no objection, if the present FIR is quashed.

In view of the above fact that the parties have amicably resolved their differences of their own free will, and without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question.

Accordingly, FIR bearing no. 292/2018, registered at Police Station Rajouri Garden, Delhi for commission of offence punishable under Sections 419/420/468/471/120B of IPC and all consequential proceedings emanating therefrom are quashed, subject to the costs of Rs.20,000/- each to be paid by the petitioners in following manner:

(i) Petitioner no. 1 shall deposit ₹20,000/- with the Delhi High Court Bar Clerk’s Association Fund

(ii) Petitioner no. 2 shall deposit ₹20,000/- with the Civil and Sessions Courts Stenographers’ Association, Delhi and

(iii) Petitioner no. 3 shall deposit ₹20,000/- with the Advocates’ Welfare Fund, Tis Hazari Courts, Delhi within a period of ten
