The petitioner/ complainant seeks quashing of FIR No. 57/2021 dated 31.01.2021, registered at P.S. Bhajan Pura, under Sections 498A, 406, 34 IPC, along with consequential proceedings arising therefrom, based on compromise arrived at between the parties.

Petitioner-Neha got married respondent No.2-Mr. Ashish Jain on 18.06.2017 as per the Hindu rites and customs. There is no child from the abovesaid marriage.

The petitioner, however, lodged complaint against her husband and in-laws, due to certain temperamental differences, resulting in the registration of FIR in question.

Fact, however, remains that charge-sheet has yet not been filed and in the interregnum, the mother-in-law of the petitioner has also reportedly expired.

The parties have, however, settled all their disputes before Delhi Mediation Centre , Karkardooma Courts, Delhi as is evident from the settlement terms dated 06.10.2023.

The petitioner, in lieu of full and final settlement, has already received a sum of Rs. 5 lacs, and the balance amount of Rs.1 lac has been received today by her during the course of proceedings by way of Demand Draft bearing No. 945742000485000 drawn on 09.01.2026 by Kotak Mahindra Bank.

The parties have also obtained divorce by mutual consent on 23.01.2025.

The petitioner is present with her counsel and is duly identified, both by her counsel as well as I.O.

Petitioner reiterates the terms of settlement and submits that the same has been arrived at voluntarily, without undue influence and coercion. She further submits that since the matter has been amicably resolved after receiving all her dues with respect to maintenance, istridhan , alimony, jewellery and having obtained divorce by mutual consent, she does not wish to pursue with further proceedings against the respondent Nos.2-6.

Petitioner also submits that she has received all her relevant documents including educational certificates, passport and Aadhar card, from respondent Nos. 2-6.

In view of the settlement arrived at between the parties, continuing with criminal proceedings would serve no useful purpose, especially, when dispute does not involve any public interest and is private in nature. In any case, the petitioner/ complainant herself does not wish to press any charges against respondents.

Accordingly, exercising inherent powers vested in this Court under Section 528 of the BNSS, it is deemed appropriate to quash the instant FIR. 13. Consequently, to secure the ends of justice, FIR No. 57/2021 dated 31.01.2021, registered at P.S. Bhajan Pura, under Sections 498A, 406, 34 IPC, along with all consequential proceedings emanating therefrom, is hereby, quashed.

The petition stands disposed of in aforesaid terms.
