Quashing of FIR on settlement — Petition under Section 528 BNSS 2023 allowed; FIR quashed. Vikram Singh and another sought quashing of FIR No.283/2017 dated 15.07.2017, PS Shalimar Bagh, Delhi (Sections 323/451/427/379/356/34 IPC) and all proceedings therefrom, in view of a Compromise/Settlement Deed dated 14.01.2026 with respondent nos.2–4, who appeared in person, affirmed its terms and raised no objection; the State (through the APP) also had no objection, merely praying for costs since State machinery had been set in motion; parties' credentials were identified by the IO. By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioners seek quashing of FIR No.283/2017 dated 15.07.2017 registered at PS.: Shalimar Bagh, Delhi under Sections 323/451/427/379/356/34 of the Indian Penal Code, 1860 ( IPC ) and all proceedings emanating therefrom, in view of the Compromise/ Settlement Deed dated 14.01.2026, arrived at between the petitioners and the private respondents, which is accompanied by their respective proofs of identities.

that though he has no objection to quashing of the FIR, however, since the entire State machinery was put in motion, he prays for imposing some costs on the private parties.

Respondent nos.2, 3 & 4, who are present in Court, also accept notice and affirmed the terms of the aforesaid Settlement Deed and have no objection to the quashing of the present FIR. 4. The petitioners and the respondent nos.2, 3 & 4 as well as their credentials, as on record, have been identified by the IO. 5. De hors the allegations and the sections involved, since the petitioners and respondent nos.2, 3 and 4 have settled the matter qua which they have also filed accompanying affidavit(s) herein, and the parties shall remain bound by all the terms and conditions thereof, as also following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58 , Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466 , this Court is of the considered opinion that continuation of the aforesaid FIR against the petitioners will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No.283/2017 dated 15.07.2017 registered at PS.: Shalimar Bagh, Delhi under Sections 323/451/427/379/356/34 of the IPC and all proceedings emanating therefrom are hereby quashed. 7.
