Petitioners seek quashing of FIR No. 102/2023, dated 11.04.2023, for commission of offences under Sections 498A/406/34/354/323 IPC 1860, registered at P.S. Moti Nagar, Delhi.

The charge-sheet has already been filed and petitioner no. 1 has already put his appearance.

Learned counsel for the petitioners submits that the Courts in Delhi do not have territorial jurisdiction to try the alleged offences, as respondent no. 2 is a permanent resident of Ghaziabad and never ever resided in Delhi.

After hearing arguments for some time, learned Counsel for the petitioners, without prejudice to his rights and contentions, seeks to withdraw the present petition with liberty to raise all these points, touching the territorial aspect, before the learned Trial court and also seeks liberty to

Learned counsel for respondent no. 2 appears on advance notice and submits that the Courts at Delhi have clear-cut jurisdiction. She, however, has no objection if the aspect of territorial jurisdiction is also considered by the learned Trial Court while hearing arguments on charge.

In view of the above, the present petition is disposed of as not pressed.

The learned Trial Court would hear both the sides with respect to aspect of territorial jurisdiction at the time of hearing arguments on charge and adjudicate the same in accordance with law.

Liberty, as prayed for, is also granted.

Pending applications stands disposed of in aforesaid terms.

All rights and contentions of parties are left open.
