By way of the present petition filed under Article 226 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner seeks extension of furlough granted by the jail authorities vidé order dated 24.04.2026, by a further period of 06 weeks.

Mr. Shannu Baghel, learned counsel for the petitioner submits, that the petitioner has sustained injury to both his hands while riding a Scooty; and that he has also fractured his right hand. Counsel submits, that the petitioner now has casts on both his forearms and hands; and is therefore not in a position to take care even of his daily chores in prison. 3. Pursuant to notice issued on 19.05.2026, the State has filed a Status Report dated 21.05.2026. Enclosed with the status report is an opinion dated 20.05.2026 given by the attending doctor at the Department of Orthopaedics, University College of Medical Sciences & G.T.B. Hospital, Delhi, which confirms that though there is no fracture on the

left wrist/hand, there is a fracture in the 5^th metacarpal of the right hand, which is a grievous injury.

Learned Standing Counsel appearing for the State submits, that as would be seen from the petitioner’s SCRB record dated 21.05.2026, he is a habitual offender. That being said, learned Standing Counsel leaves it to the court to pass appropriate orders.

Though it was initially submitted on behalf of the petitioner that he had suffered fracture in both hands, the medical report states that there is a fracture only in his right hand; and the injury on the left wrist and hand is ‘simple’ in nature.

Be that as it may, by way of abundant indulgence, and considering the difficulties that the petitioner may face in prison since he has a fracture in his right hand, the petition is disposed-of extending the furlough granted to the petitioner vidé order dated 24.04.2026 by the jail authorities by a further period of 10 days from today , on the same conditions as were imposed by the jail authorities.

The extended period of furlough shall be counted towards the next spell of furlough, as per the petitioner’s entitlement.

It is made clear that no further extension of furlough will be granted.

Petition stands disposed-of in the above terms.
