The present petition has been filed seeking transfer of the proceedings arising out of FIR No. 285/2020 dated 30.07.2020, registered at Police Station Ranjit Nagar, Delhi, for offences punishable under Sections 465/469/471/408/506 of the Indian Penal Code, 1860, presently pending before the Court of the learned ACJM, West, Tis Hazari Courts, Delhi, to the Special Court constituted pursuant to the judgment of this Court in Rakesh Kumar Kalra Deaf Divyang v. State Govt. of NCT Delhi¹ .

Mr. Tarkeshwar Nath, learned counsel for the petitioner, submits that the aforesaid FIR was registered against the petitioner, and that the proceedings are presently pending for consideration of an application for

discharge filed by him. Mr. Nath further submits that the petitioner is a person suffering from 100% permanent visual impairment [blindness] and is aggrieved by the inordinate delay in adjudication of the discharge application, which, according to him, has remained pending since July 2025.

The judgment in Rakesh Kumar Kalra Deaf Divyang pertains to the constitution of Special Courts for matters arising under the Rights of Persons with Disabilities Act, 2016. The present case, however, does not arise out of any offence or proceedings under the said enactment and, therefore, does not fall within the category of matters contemplated therein.

Mr. Nath submits, upon instructions from the petitioner who is present in Court, that the petitioner would be satisfied if a direction is issued to the Court where the discharge application is presently pending to consider and decide the same expeditiously within a stipulated time frame.

Having regard to the fact that matters concerning persons with disabilities are accorded priority, the concerned Court is requested to consider and dispose of the petitioner’s discharge application as expeditiously as possible, preferably within a period of three months, subject to the petitioner not seeking unnecessary adjournments. Mr. Sanjay Lao, learned Standing Counsel for the State, also assures the Court that the prosecution shall extend full cooperation towards the expeditious disposal of the application.

It is clarified that this Court has not expressed any opinion on the merits of the matter, and the petitioner shall remain at liberty to pursue all
