By way of the present petition filed under Article 227 of the Constitution of India read with section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023 (‘BNSS’), the petitioners seek expeditious disposal of their Application dated 14.08.2024 filed under section 175(3) of the BNSS that is pending before the learned Magistrate.

Learned counsel appearing for the petitioners submits, that the petitioners are about 92 years old and have been constrained to file the aforementioned application seeking registration of an FIR against their son, daughter-in-law and certain officials of respondent No.4 bank, concerning allegations of forgery and fabrication of documents and other offences.

Counsel submits, that in an Action Taken Report dated 30.09.2024 filed by the Investigating Officer (‘I.O.’) from P.S.: Ranjit Nagar, it has been stated that the documents allegedly forged and used for loan

to-up were filed with the DCB Bank, Karol Bagh Branch, New Delhi, which falls under the jurisdiction of P.S.: D.B.G. Road; and that therefore the matter be sent to that police station.

Counsel argues that merely because the forgery had been committed within the jurisdiction of a different police station did not warrant the I.O. not to proceed with the matter.

Mr. Hemant Mahela, learned APP appears on behalf of the State on advance copy; accepts notice; and leaves it to the court to pass appropriate orders.

In view of the prayer made, it is not considered necessary to issue notice to respondents Nos. 2 to 4.

Considering that the application under 175(3) of the BNSS has been pending since August 2024, the present petition is disposed-of; with a direction to the learned Magistrate to decide the application as expeditiously as possible, and in any event, within 02 months of the next date of hearing before that court, which is stated to be 07.03.2026.

The present petition is disposed-of in the above terms.
