Delhi High Court (Saurabh Banerjee, J.) allowed CRL.M.C. 145/2026, a petition under Section 482 CrPC read with Section 528 BNSS, seeking quashing of FIR No. 202/2023 dated 04.06.2023, PS Tigri, Delhi, registered under Sections 498A/406/34 IPC. The petitioners and respondent no.2 had settled their disputes vide a Mediation Settlement dated 28.10.2025 before the Mediation Centre, Saket Courts, New Delhi, and had started living together peacefully; the settlement was annexed with affidavits and ID proofs. The learned APP for the State and respondent no.2 both stated they had no objection to quashing, and the credentials of the parties were identified by the Investigating Officer. Following Jitendra Raghuvanshi (2013) 4 SCC 58, Gian Singh (2012) 10 SCC 303 and Narinder Singh (2014) 6 SCC 466, the Court held that continuation of the FIR would be an exercise in futility, quashed the FIR and all proceedings emanating therefrom, directed the parties to remain bound by the terms of the settlement, and disposed of the petition alongwith the pending application.

By virtue of the present petition under Section 482 of the Code of Criminal Procedure, 1973 ( CrPC ) read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 ( BNSS ), the petitioners seek quashing of FIR No. 202/2023 dated 04.06.2023 registered at PS: Tigri, Delhi under Sections 498A/406/34 of the Indian Penal Code, 1860 ( IPC ) and all proceedings emanating therefrom, in view of the Mediation Settlement dated 28.10.2025 arrived at between the petitioners and the respondent no.2.

The present petition is also accompanied by the said Mediation Settlement dated 28.10.2025 and is also supported by affidavit(s) of the petitioners and respondent no.2 alongwith proofs of their respective I.D.s.

Learned APP for the State accepts notice, and submits that she has no objection to the quashing of the aforesaid FIR No. 202/2023 dated 04.06.2023.

Respondent no.2, present through video conferencing, also accepts notice and confirms that the petitioners and respondent no.2 have settled their disputes before the Mediation Centre, Saket Courts, New Delhi and have started living together peacefully. Lastly, respondent no.2 states that she has no objection to the quashing of the FIR.

Further, the petitioners and the respondent no.2, present through video conferencing, as well as their credentials, as on record, have been identified by the Investigating Officer.

In view of the fact that a settlement has already been arrived at between the parties, they shall remain bound by all the terms and conditions contained therein. As such, following the law laid down by the Hon’ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466 , this Court is of the opinion that continuation of the aforesaid FIR No. 202/2023 dated 04.06.2023 will be an exercise in futility.

Accordingly, the present petition is allowed and FIR No. 202/2023 dated 04.06.2023 registered at PS: Tigri, Delhi under Sections 498A/406/34 of the Indian Penal Code, 1860 (IPC) and all proceedings emanating therefrom are quashed.
