Petitioner seeks quashing of complaint case bearing MC No.456/2025 which has been filed by his daughter-in-law (respondent No.1 herein) under Section 12 of Protection of Women from Domestic Violence (PWDV) Act , 2005. On the basis of receipt of the abovesaid complaint, learned Trial Court i.e. learned JMFC, Mahila Court – 03, West, Tis Hazari Courts, Delhi had issued summons to the petitioner herein to appear before it.

According to petitioner, the abovesaid complaint is complete misuse and abuse of process of law and the complaint has been filed with a malafide intent to frustrate and prejudice the rights of the petitioner.

It is informed that there was a decree passed by the learned Civil Court in favour of the petitioner herein and to nullify the effect of the maintenance granted by the learned Maintenance Tribunal in favour of the present petitioner, the provisions of PWDV Act have been misused so as to coerce the

petitioner to enter into some settlement. It is also submitted that the proceedings initiated by respondent No.1 are highly belated and nothing but afterthought and counterblast.

The next date before the learned Trial Court is stated to be 16.03.2026.

After hearing arguments for some time, learned counsel for the petitioner submits that he would urge all the contentions raised before this Court, before the learned Trial Court at appropriate stage and, therefore, without prejudice to the rights and contentions, at this stage, he does not press the present petition. He, however, seeks liberty to file the petition afresh at a subsequent stage.

Petition is accordingly disposed of as not pressed. Liberty, as prayed, is granted.
