Manisha Vs Bhaskar & Ors.

The petitioner is the wife of respondent No. 1. The parties are engaged in several litigations, including proceedings for maintenance. 2. By order dated 08.01.2026 [in M.T. Case No. 397/2023], the learned Judge, Family Court, District North-West, Rohini Courts [“Family Court”], directed respondent No. 1 to pay interim maintenance of Rs. 36,000/- per month to the petitioner and the minor child of the parties.

By way of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, the petitioner alleges that respondent No. 1 is in the process of selling an immovable property, i.e., a restaurant

situated at Shop No. 27, CSC No. 2, Sector-6, Rohini, Delhi, [“property”] to respondent Nos. 2 and 3. She seeks an injunction restraining the sale of the said property.

The petitioner has not initiated any proceedings for execution of the maintenance order. It is evident from the order of the Family Court that a period of six months has been granted to respondent No. 1 for clearing the arrears of interim maintenance.

Respondent No. 1 is represented by his counsel, Mr. Nimish Chib, and is personally present in Court. I am informed that the sale of the said property has already taken place and respondent No. 1 has received approximately Rs.21,00,000/- from the sale.

Mr. Chib, on instructions, undertakes that respondent No.1 will liquidate all arrears of maintenance due to the petitioner and the minor child, as per the order dated 08.01.2026, within a period of two weeks from today. As far as the current maintenance amount for the months of January and February 2026 is concerned, the same has been partially paid, and the outstanding amount for these two months will be paid by respondent No. 1 within two days from today.

Learned counsel for the parties request this Court that the parties be referred to Samadhan , Delhi High Court Mediation and Conciliation Centre, Shershah Road, New Delhi –110503, so that a comprehensive settlement of all the disputes can be worked out, if possible. Accordingly, the parties are directed to appear before the learned Mediator on 02.03.2026.

Learned counsel for the petitioner further reserves the right of the petitioner to pursue appropriate civil proceedings, on account of the sale

of the said property, if permissible in law, on her own behalf, and/or on behalf of the minor child.

The petition, along with the accompanying application, is thus disposed of, in terms of the above submissions.

While it is hoped that the parties will make an earnest effort to settle their disputes comprehensively in mediation, it is made clear that this order is not intended to prejudice the parties in exercise of appropriate remedies, in accordance with law, if necessary at any stage.
