The present Writ Petition has been filed under Article 226 of the Constitution of India read with Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking issuance of a Writ in the nature of Habeas Corpus, directing the respondents to produce Master X before this Court and directing the Respondent Nos. 1 to 3 and 8 to ensure the safety and security of Master X and also a direction to the Mahila Court to hear the matters of visitation and custody of the

children on priority for the sake of their lives and extensive welfare.

The petition itself disclosed that there are matrimonial disputes between the petitioner and the respondent no.4, for which the petitioner has even availed of her legal rights. The complaint of the petitioner is that in the proceedings that she had taken, the respondent no.4 is not bringing the child to the Court in spite of directions from the Court.

Notice of this petition was issued to the respondents vide order dated 28.03.2025.

Today, the child appears before us virtually. Along with him Mr.Om Prakash Sharma, Principal of the school where he is studying, is also present.

We are of the opinion that as the petitioner has already availed of her legal remedy for the custody and visitation right over the child, no further direction can be passed in the present petition. The concerned Court is competent to decide all the disputes and also to pass appropriate directions in such proceeding in accordance with the law.

Accordingly, we dispose of the present writ petition, leaving the parties to their own respective remedies in accordance with law.
