A status report has been filed on behalf of the respondent / Municipal Corporation of Delhi (MCD), which inter alia reads as under:

“ 3. That, pursuant to demolition/sealing order already stand passed, action against subject properties was planned for 19.07.2025, but the same could not be executed, due to shortage of time, as action on the said date was started from Property No.F-13/10A, Sir Syed Road, Jogabir Extension, Near Okhla, New Delhi involved in “W.P. (C) No. 13237/2025 titled as Ragib Khan Vs MCD” and time left after the said action was not sufficient to take action at subject properties.

4. That, further action against subject properties was planned for 15.01.2026. During the action upon availability of Police Force, demolition action was taken at Property Opp. S-17/10 & Adjoining 18/99, Jogabai Extension, New Delhi. During the action, 02 number of RCC panels were demolished at the roof slab of 5^th floor and reinforcement of above panels were cut down using gas cutter. Photographs showing the action as taken by the department on 15.01.2026 are annexed herewith as Annexure: A (Colly.) .

5. That, pursuant to aforesaid action, a letter bearing No.D/343/AE(B)I/CNZ/2026 dated 16.01.2026 has been sent to the SHO, PS Jamia Nagar with the request to keep strict vigil over the property, so that Owner/Builder may not be able to restore the demolished portion. Copy of watch & ward letter dated 16.01.2026 is annexed herewith as Annexure: B .

6. That, during the action, property No.S-18 to 16, infront of S-17/10, Jogabai Extension, Batla House, New Delhi was inspected. During inspection, seals affixed at subject property on 06.05.2024 were found intact. Photographs showing the present status of the property are annexed herewith as Annexure-C . ”

Considering that the action, as set out in the status report has been taken by the MCD, it cannot be said that there has been any wilful disobedience by the MCD of orders passed by this Court. Further, learned counsel for the MCD submits and undertakes that further action as may be warranted shall be taken in accordance with law to remove any unauthorized construction in respect of the properties in question.

The said statement is taken on record.

It is made clear that in the event of any deficiency on the part of the MCD or any other authority in taking requisite action, it shall be open to the petitioner to avail appropriate remedies as prescribed under law.

In such event, the petitioner shall also implead the concerned occupants of the properties with regard to which action is sought to be taken.

No further orders are required to be passed in the present petition. The same is accordingly, disposed of in the above terms.
